I note the candidate is GOP, but in Henley's case I'd say that doesn't guarantee that Henley himself is Dem...

Henley's a long-standing "Hollywood liberal" (as they say on Faux News), his Wal-Mart deals notwithstanding. It's an interesting case; we've seen this repeatedly with candidates using songs without permission (see: Heart, Jackson Browne, etc) and most will cease and desist when asked. But this GOP guy not only took Henley's songs but wrote new lyrics, so naturally he's using the First Amendment "parody" defense. Not sure if Henley has an argument here, esp if the guy's paying royalties for the use of the melody.

The Senator would win such a case, if it goes that far.  Weird Al asks for permission for all his parodies, but only as a courtesy; he is not obligated by law to do so.  What's good for the goose is also good for the gooser.
