Who is this?  It sounds like something I may not have heard since '77.

ETA: Nevermind, Ginger confirmed my suspicions that it was Gabriel.

not to mention Phunky Phil on drums!

BOS4 Townsend/Lane --another flashback. Spent a lot of time driving around that fall, listening to the radio and trying to decide whatthehell to do with my life. And this LP and Aja were constantly on the local FM prog-rocker.

Yep. I remember having a Burger Chef for a time in Sacto in the mid-60s. They didn't last out here though. And I'd be surprised if Burger King sued them successfully--I think Burger Chef preceded them.

and here's the inevitable Aja track. VHM "Black Cow" -- a root beer milkshake, or so it was explained to me.

I think they were pretty exclusively a regional midwestern chain.  Don't know about any suit, but they were bought by Hardee's which eventually combined with Carl's Jr. (I forget who bought whom).

but per wikipedia and several other sources, it's a root beer float and sometimes a Coke Float is called a Black Cow too.

kudos to Ginger for a fine '77 set.  Maybe Dave'll make it a two-fer: it's been exactly a month since he last visited the year.
